Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of MachePOS, operated by Kolas Consulting LLC (“MachePOS,” “we,” “us,” or “our”), including the MachePOS mobile application (Android), the web portal at app.machepos.com, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

MachePOS provides point-of-sale, inventory, sales reporting, staff management, customer records, and related business-management features for merchants. Features available to you depend on your subscription plan.

3. Accounts and Eligibility

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for the accuracy of your account information and for keeping your login credentials and staff PINs confidential.
• You are responsible for all activity that occurs under your account and for your authorized staff’s use of the Service.
• Notify us promptly at info@machepos.com if you suspect unauthorized access.

4. Subscriptions, Billing, and Payments

• MachePOS offers Free and paid subscription plans. Paid plan features apply while your subscription is active.
• Subscription billing is processed through our payment providers (including PayPal). Merchant customer payments you collect may be processed through integrated mobile-money and payment partners (including PAYM / MonCash / NatCash / KashPaw), depending on your country.
• We do not store your mobile-money PIN or full payment credentials — only transaction references and subscription status needed to operate the Service.
• Fees are billed in advance for the applicable period and are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of the current billing period.

5. Your Data and Ownership

• Your business data (products, inventory, pricing, sales, customers, staff, expenses) belongs to you.
• You grant us a limited license to host, process, and display that data solely to provide and improve the Service.
• You are responsible for the lawful collection and use of any customer information you enter, and for complying with applicable privacy laws in your jurisdiction.
• Our handling of personal data is described in our Privacy Policy at machepos.com/privacy.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or abusive purpose;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Reverse engineer, resell, or misuse the Service except as permitted by these Terms.

7. Third-Party Services

The Service relies on third-party providers, including Supabase and Vercel (hosting and infrastructure), the WhatsApp Business Platform / Cloud API provided by Meta Platforms (for optional business messaging you opt in to), and payment providers (PayPal and mobile-money partners such as PAYM / MonCash / NatCash / KashPaw). Your use of those features may be subject to the third party’s own terms. We are not responsible for third-party services we do not control.

8. Service Availability and Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for maintaining your own records where appropriate.

9. Limitation of Liability

To the maximum extent permitted by law, Kolas Consulting LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months preceding the claim.

10. Termination

You may stop using the Service and delete your account at any time (see machepos.com/data-deletion). We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the Service. Upon termination, your right to use the Service ends; data deletion is handled as described in our Privacy Policy and Data Deletion pages.

11. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws applicable to Kolas Consulting LLC, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of competent jurisdiction for that entity.
